What Is the Prospective Marriage Visa?
The Prospective Marriage Visa (subclass 300) allows the fiancé of an Australian citizen, permanent resident, or eligible New Zealand citizen to travel to Australia for the purpose of getting married.
This temporary visa is valid for up to 12 months and gives you the opportunity to enter Australia, marry your partner during that time, and then apply for an onshore Partner Visa (subclass 820/801).
You must be outside of Australia when you apply for this visa.
This visa is ideal for couples who are engaged and planning their wedding in Australia, and who want to build a life together after marriage.

What is the difference between the 300 and 309 visas?
The subclass 300 is for engaged couples who intend to marry in Australia within 12 months of the visa being granted. The subclass 309 is for couples who are either legally married or in a de facto relationship. Both visas are temporary pathways to permanent residency through a subsequent partner visa.
Can I apply for a 300 visa if we haven’t lived together?
Yes. The 300 visa is designed for engaged couples who may not have lived together. However, you must have met in person at least once and intend to marry within 12 months of the visa being granted. You’ll also need to provide evidence of a genuine and ongoing relationship and your future plans together.
Can we apply for a 309 visa if we’re not married?
Yes. You can apply as de facto partners if you’ve lived together for at least 12 months, or if your relationship is registered in an Australian state or territory that recognises registered relationships. If you're already married, you must provide a marriage certificate.
Can we register our relationship if we live overseas?
Some states allow one partner to reside outside Australia to register the relationship, but most require at least one partner to be living in that state. It's important to check the specific requirements of the state in which you wish to register.
Can we apply for either visa if we haven't met in person?
Generally, no. Meeting in person at least once is a requirement for both the 300 and 309 visas. The only exceptions are in rare circumstances, such as religious or culturally arranged marriages where an in-person meeting hasn’t occurred but the marriage is legally recognised.
Can I visit Australia while my visa is being processed?
Yes. You may apply for a visitor visa while your offshore partner or prospective marriage visa is being processed.
How long does it take to process these visas?
Processing times vary depending on individual circumstances and the quality of your application. On average, the 300 and 309 visas can take anywhere from 8 to 24 months. Strong, well-prepared applications may be processed more quickly.
What documents do we need to prepare?
You will need to provide identity documents, relationship evidence, character checks, and statements from both partners. For the 300 visa, you will also need a Notice of Intended Marriage lodged with a celebrant in Australia. We will guide you through all document requirements in detail.
What are the fees involved?
The government fee for the initial 300 or 309 visa is $9,095. Our professional fee is $3,000 plus GST, with 50% due upfront and the remaining balance due at time of submission.
